Application - 12 Shaw Street
The city received an application for construction of a Single Detached Dwelling with a proposed Side Yard (abutting a street) of 5.6 metres. For a Single Detached Dwelling the Side Yard requirement is 6 metres when abutting a Street. The applicant is requesting a Variance on the minimum Side Yard requirement to be considered under Section 7.4 of the City of St. John’s Development Regulations which allows up to a 10% Variance from any applicable requirement to be considered.
In general terms, Section 7.4 can allow Council to grant a Variance from the applicable requirements to a maximum of 10%. A variance of 6.7% is required which will result in a Side Yard of 5.6 meters.
