Application - 62 Old Bay Bulls Road

The city received an application for construction of an Accessory building with a proposed height of 5.4 metres. For a Residential Use, Accessory Building height shall not exceed 5 metres. The applicant is requesting a Variance on the minimum Accessory Building height to be considered under Section 7.4 of the City of St. John’s Development Regulations which allows up to a 10% Variance from any applicable requirement to be considered.

In general terms, Section 7.4 can allow Council to grant a Variance from the applicable requirements to a maximum of 10%. For a Residential Use, the Accessory Building height shall not exceed the lesser of 5 metres or the height of the main residential Building on the Lot. To accommodate the proposed development, a variance of 7.2% is required, which will result in an Accessory Building height of 5.4 metres.
